Know Your Rights โ€” What the Law Actually Says About Fathers

Most fathers going through separation don't even know what the law says about their rights. That ends today.


The Care of Children Act 2004 is clear - both parents have rights and responsibilities. A relationship ending does not mean your role as a father ends. It is not a one-way street.


Here are some key things every father needs to know:


๐Ÿ“– Guardianship is equal. Both parents are guardians of their children. That means you have an equal say in major decisions - education, medical care, religion, name changes, and where your tamariki live.


๐Ÿ“– Children have the right to a relationship with both parents. The law recognises that ongoing contact with both parents is in the best interest of the child. No one gets to take that away because they're angry.


๐Ÿ“– Day-to-day care is not ownership. Even if your children primarily live with one parent, it does not strip the other parent of their guardianship rights or their voice.
